Extraterritorial Jurisdiction (ETJ)

The Extraterritorial Jurisdiction (ETJ) is the unincorporated land within five miles of the City of San Antonio boundaries and is not located in another city's municipal or ETJ boundaries. It is the area in which the City of San Antonio is able to annex land, with the consent of the landowner or voter approval; and extend certain regulations where development can affect the quality of life within the City. ETJ regulations help to ensure that development that may petition to be annexed in the future meet certain minimum standards by the City, its service providers, and local utilities.

Senate Bill 2038 - ETJ Release Petitions

Newly enacted state law allows landowners or residents to submit a written petition to a city to release their property from the city's extraterritorial jurisdiction (ETJ). In the 88th (Regular) Texas legislative session, Senate Bill 2038 was passed and is effective as of September 1, 2023. The newly enacted Local Government Code, Chapter 42, Subchapters D and E codified and established a petition and election process for releasing property from a city's ETJ.
